Introduction

These Terms of Service ("Terms") govern your use of yoshidigital.com and any services provided by Yoshi NEXUS LLC, doing business as YoshiDigital ("we," "us," or "our"). By accessing our website or engaging our services, you agree to these Terms.

Services

YoshiDigital provides:

• Web design and development
• Media production (photography, videography, drone footage, professional editing)
• SEO and digital marketing
• Website hosting and maintenance
• Branding and logo design

Specific deliverables, timelines, and pricing are agreed upon on a per-project basis before any work begins.

Quote Builder

• Prices displayed in our online quote builder are estimates intended to give you a general idea of costs
• A final quote will be confirmed in writing before any work begins or payment is collected
• Promo codes and discounts are subject to availability and may be modified or discontinued at any time without notice

Payments

• Payment terms, including deposit requirements and payment schedules, are agreed upon per project before work begins
• YoshiDigital reserves the right to pause or suspend work if payment is not received as agreed
• Accepted payment methods will be communicated at the start of each project

Revisions

Each website package includes a specified number of revision rounds as outlined in the project agreement:

• Starter / Portfolio: 1 round of revisions
• Standard: 2 rounds of revisions
• Premium: Unlimited revisions

Additional revisions beyond the included amount may incur additional charges, which will be communicated before any work is performed.

Ownership and Deliverables

• Upon receipt of full payment, all code, designs, photographs, videos, and other assets created specifically for your project become 100% your property
• YoshiDigital retains the right to showcase completed work in our portfolio and marketing materials unless you request otherwise in writing prior to project completion
• Third-party tools, frameworks, and open-source software used in your project remain subject to their respective licenses

Hosting and Maintenance

• Hosting plans are billed on a monthly basis
• Either party may cancel a hosting plan with 30 days written notice
• YoshiDigital is not liable for downtime, data loss, or service interruptions caused by third-party hosting providers, DNS issues, or events outside our control
• We will make reasonable efforts to maintain uptime and resolve issues promptly

Project Cancellation

• Either party may cancel a project by providing written notice via email
• If you cancel, work completed up to the cancellation date will be billed proportionally based on the project scope
• Any deposits paid are non-refundable, as they cover initial project setup, planning, and resource allocation
• If we cancel, any unused deposits will be refunded and all completed work will be delivered to you

Client Responsibilities

• You are responsible for providing content (text, images, logos, credentials) in a timely manner as requested
• You must have the legal right to use any content you provide to us for inclusion in your project
• Delays in providing requested materials may result in project timeline extensions
• YoshiDigital is not responsible for copyright or intellectual property issues arising from client-provided materials

Limitation of Liability

• YoshiDigital's total liability for any claim arising from our services shall not exceed the total amount you paid for the specific service in question
• We are not liable for any indirect, incidental, consequential, or special damages, including but not limited to lost revenue, lost profits, or lost business opportunities
• We do not guarantee specific business results, search engine rankings, or traffic increases from our services

Intellectual Property

• The YoshiDigital name, logo, and brand identity are the property of Yoshi NEXUS LLC
• You may not use our branding without written permission
• We respect the intellectual property of others and expect our clients to do the same

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oklahoma. Any disputes arising from these Terms or our services shall be resolved in the courts of Tulsa County, Oklahoma.

Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
